RESOLUTION #2-06

Submitted for Consideration by FCLB Board of Directors 

WHEREAS, the 2005 report from the US Office of Health and Human Services - Office of the Inspector General extrapolates from a review of records from 2001 that a number of claims submitted to Medicare were flawed, and

WHEREAS, the same report noted 2/3 of all chiropractic claims failed to document medical necessity, and

WHEREAS, the public interest is best served by all health care providers maintaining accurate records of patient visits, including appropriate documentation of medical necessity; and

WHEREAS, chiropractic regulatory boards are empowered to enforce documentation and recordkeeping practices by doctors of chiropractic, and public protection will be enhanced from focused regulatory emphasis on these practice areas; now therefore be it

RESOLVED, that the Federation of Chiropractic Licensing Boards (FCLB) encourages member boards to require approved continuing education in documentation and recordkeeping as a condition for relicensure; and be it

Further RESOLVED, that the FCLB work with the Council on Chiropractic Education (CCE) and other interested stakeholders to encourage inclusion of acceptable documentation and recordkeeping as part of the chiropractic curriculum; and be it

Further RESOLVED, that the FCLB encourage the examinations of the National Board of Chiropractic Examiners to reflect this aspect of the curriculum as may be appropriate.

RESOLUTION #3-06

WHEREAS, training in emergency medical measures is an important aspect of clinical competency and timely responsiveness to an event; and

WHEREAS, the doctor of chiropractic is often the first and direct contact with the patient in the delivery of chiropractic health care; and

WHEREAS, medical emergencies may occur in the chiropractic clinical setting and must be addressed; now therefore be it

RESOLVED that the Federation of Chiropractic Licensing Boards (FCLB) encourages member boards to promote CPR and AED training of licensees to aid in their preparedness to respond to emergency situations.

RESOLUTION #4-06

 Submitted for Consideration by Reiner G. Kremer, D.C. - Colorado

WHEREAS, Obtaining and maintaining malpractice insurance is an important aspect of public protection; and

WHEREAS, there is an inherent lack of standardization for key elements of malpractice insurance among the regulated jurisdictions; now therefore be it

RESOLVED that the Federation of Chiropractic Licensing Boards (FCLB) encourages member boards to promote that licensees maintain continuous malpractice coverage encompassing the entire scope of practice.

RESOLUTION #5-06

Submitted for Consideration by FCLB Bylaws & Resolutions Committee

WHEREAS, the FCLB's Model Code of Ethics for board members has been adopted by the FCLB membership; and

WHEREAS, a number of other regulated professions have adopted a slightly modified version of this document developed and endorsed by the Federation of Association of Regulatory Boards; and

WHEREAS, The FCLB and its member boards are well served by developing a concise statement of principles, ethical behavior, non- disclosure, and conflict of interest for its volunteers and staff; now therefore be it

RESOLVED that the Federation of Chiropractic Licensing Boards (FCLB) develop a draft of such a statement by September 1, 2006, for initial review by its member boards at the fall regional meetings and through such other forums as may be deemed appropriate.
